Terms and Conditions (GTC)

General

Dear Customer,

The following terms and conditions apply to the provision of tourism services by third-party providers as an intermediary by Seemezy Booking GmbH (hereinafter referred to as "Seemezy") and form part of the agency agreement concluded. They complement and supplement the legal provisions of Sections 675 and 631 of the German Civil Code (BGB) applicable to the travel agency agreement. Please read these terms and conditions carefully before making a booking!

Our online presence via the website www.seemezybooking.com is offered for customers' non-commercial use. The use of our online presence (our website) and the services provided therein is subject to the following general terms and conditions:
 

Arranging Travel, Air Transport, and Other Tourism Services

1. Scope

1.1. Seemezy Booking GmbH, headquartered at Bischoff-Ketteler-Str. 10, 52222 Stolberg (HRB 25286), provides travel, flights, hotel services (air tickets and/or hotel accommodations), travel insurance, car rentals, and other tourism services (hereinafter referred to as "tourism services" or "travel products") from various tour operators (hereinafter referred to as "providers") via its website. Providers under these terms include airlines, hotel operators, travel insurers, car rental companies, cruise operators, or other tour operators.

As a customer, you can use the website to enter into agreements with the relevant providers for tourism services through Seemezy.

1.2. Seemezy acts as an independent broker in the field of travel products, including or excluding insurance, and does not have exclusive relationships with any travel provider. If you have any questions regarding travel offers or other correspondence related to your booking with Seemezy, please send them to info@seemezybooking.com or call us at +49 (0) XXX (telephone provider's local rate applies).

1.3. If you book a tourism service from a (third-party) provider, an agency agreement for the provision of tourism services will be concluded between you and Seemezy. Regarding the providers' services, Seemezy only acts as an intermediary for tourism services and arranges contracts solely on behalf and for the account of the relevant provider. Unless mandatory legal provisions dictate otherwise, the mutual rights and obligations of the customer and Seemezy derive from the contractual agreements made in each case, these brokerage conditions, and statutory regulations.

1.4. All bookings made via our website and/or other communication platforms (e.g., WhatsApp, email, and/or telephone bookings) are restricted to persons aged 18 or older. As a customer, you guarantee that all information provided about yourself or your travel companions is accurate. Additionally, the customer immediately becomes the contact person for the provider and remains responsible for all information provided to the agency concerning all guests/passengers.

1.5. You may not resell, broker, or otherwise transfer the services obtained through our website to third parties for a fee. Our website may only be used as permitted by law and in compliance with the terms and conditions, particularly these general terms and conditions. The booking and reservation of tourism services under this agreement and the lawful use of other functions available on the website are subject to these terms.

1.6. Seemezy reserves the right to block access to the website and/or online services at any time for good cause.
 

2. Booking and Conclusion of Contract

2.1. "Booking" refers to your offer to purchase or use the products or services described on our website. The contract for the selected tourism services is concluded between you and the respective provider.

2.2. The provider's general terms and conditions (including the airline's conditions of carriage) apply in addition to Seemezy's terms and conditions.

The providers' general terms and conditions may regulate payment conditions, provisions on deadlines, liability, cancellation, rebooking, refunds (if any), and other booking and tariff conditions. Please pay attention to the references to third-party terms and conditions on our website. If necessary, we recommend consulting the relevant provider about applicable terms and conditions before completing your booking.

2.3. The tourism services offered on our website or via our booking hotline and possibly sent by email do not constitute a binding contract offer from Seemezy and/or the respective provider. The offer is made to conclude a contract with the provider of the desired tourism service. You submit your offer by entering your details in the online booking form and sending it to us. For telephone bookings, your offer is submitted following a previous telephone conversation and response to an information email from Seemezy. Once you, as a customer, make a booking—that is, submit an offer to conclude a contract—the provider will process your offer as soon as possible and respond within 3 to 7 days. During this period, you are bound by your offer to conclude the contract. Within this period, Seemezy may declare that it has accepted the customer's offer on behalf of the respective provider or directly through the respective provider by sending a confirmation. Upon transmission of the confirmation, the tourism service contract is deemed concluded. The contract is also concluded if we or the provider send you an invoice.

2.4. If we need to send you a new contract offer, you can accept it within the period specified in the offer. In this case, the contract for the tourism service is concluded when you accept the new offer sent by us or the respective provider.

2.5. Neither Seemezy nor the provider is obligated to accept an offer.

2.6. The customer's order data and contract text are stored by us for contract processing purposes. As part of the contract processing, Seemezy transmits contract data to the providers selected by the customer. Once the provider confirms acceptance of the offer, all information regarding the concluded contracts will be provided to the customer electronically.

2.7. Seemezy has no special obligation to provide information or advice regarding legal or otherwise regulated travel conditions related to the destination country or other travel conditions.


3. Payment

3.1. To book a tourism service through our website, complete the booking process by making a payment via the payment service provider. For other bookings, you will be required to transfer the payment amount to the relevant recipient account.

3.2. Your booking will be confirmed upon receipt of payment for the selected travel product ("Booking Confirmation"). If you book through our website and make a payment ("online booking"), you will receive booking confirmation immediately. For telephone bookings, confirmation will be sent within 24 hours of receipt of payment. Please note that payments for air transportation contracts must generally be made immediately upon receiving confirmation from the airline. The same applies to car rentals. In the case of car rentals, if you rent a car outside the rental station's working hours, additional charges to be paid on-site may apply. Depending on the booked tourism services, payments are collected either by the provider itself, Seemezy, or the service provider used for debt collection.

3.3. Seemezy explicitly states that the tourism services (travel products) offered on the website are subject to the availability and restrictions of the respective provider (tour operator, etc.). Seemezy continuously updates the website concerning the listed tourism services, making it unlikely for an offered service to be unavailable. However, Seemezy cannot rule out that the booked service may no longer be offered by the provider. In such cases, Seemezy reserves the right to cancel your online booking within 24 hours and refund the full amount paid to your bank account. If you book hotel accommodation through our website, we recommend waiting for confirmation of the contract before booking your flight or other travel products. You will receive confirmation of the contract within 24 hours of your online booking.

3.4. If Seemezy or a service provider used for collecting invoices collects payments for travel products, this is done on behalf and for the account of the respective provider. If Seemezy is the authorized collection agent of the provider, the above provisions also apply to the intermediary provider's cancellation fees (cancellation compensation) and other justified claims arising from legal or contractual obligations.

3.5. Payments are generally made via credit card, direct debit, SEPA direct debit, bank transfer, or cash payment at a travel agency. If you book through our website, the payment options will be displayed on the site. Payments to tourism service providers may be made by credit cards (e.g., VISA, MasterCard) if the provider accepts these payment methods. Customers can find more information about the offered payment methods in the booking process details and the terms and conditions of the tourism service provider. Seemezy does not guarantee that the provider always accepts specific payment methods.

3.6. We reserve the right to charge the customer any chargeback fees for unused credit card charges or automatic payments from the bank.

3.7. As a rule, Seemezy does not provide "linked travel services" within the meaning of Section 651w of the German Civil Code (BGB), only individual travel services. In exceptional cases where a reservation is made for a relevant travel service, Seemezy will provide the customer with the necessary financial protection and issue the relevant security certificate to the traveler.
 

4. General Contractual Obligations

4.1. If you make a mistake in your details as a customer...

4.4. If you are subject to special needs or restrictions regarding the requested tourism service, it is in your interest to inform Seemezy about this. Seemezy accepts no liability in the absence of such notification. Other contractual and/or legal obligations of the customer to report defects remain unaffected.


5. Processing

5.1. In case of questions, our customers are supported by our service center. This information is available daily during the hours specified, accessible via the contact page in the service area of our website, and the phone numbers listed in the legal notice.

6. Service Fees

6.1. The following applies to prices and service fees for the arrangement of air transportation services from airlines:

  • The stated and invoiced prices are airline prices and do not include any commission or other fees charged by Seemezy for its activities with the airline.

  • Seemezy’s fee for this brokerage activity is solely based on the service fees payable by the customer.

  • Service fees for Seemezy’s brokerage activities and other activities related to flight reservations are derived from the fees agreed upon and communicated to the customer during the booking process, unless otherwise agreed in individual cases.

6.2. Separate agreements apply to the provision of other tourism services of an individual nature and other activities carried out on behalf of the customer. The customer will be informed of this through visible notification, including during the booking process.

Seemezy’s claim to any service fee—including for flight arrangements—remains valid in the event of service interruptions or changes, particularly in the case of rebooking, name changes, withdrawal, cancellation, or termination of the brokerage agreement by the service provider or the customer. This does not apply if the customer is entitled to a refund due to deficiencies in the agent’s consulting or brokerage activities under contractual or statutory claims.
 

7. Travel Documents

7.1. Regarding the delivery of travel documents, we refer to the relevant regulations in the travel conditions of the respective provider, which will be presented to you before booking.

7.2. Seemezy will only inform customers about entry and visa requirements if explicitly agreed. Otherwise, the obligation to provide such information arises only if special circumstances known or apparent to the agency require clear reference and such information is not already included in the offer documents provided to the customer. This also applies to information about customs regulations, health entry regulations, import and export regulations, etc.

7.3. Airlines typically offer electronic tickets (e-tickets) instead of paper tickets. As a rule, an electronic reservation code in text form (usually sent via email) is provided, which the customer must present or show during check-in along with a form of identification (ID card or passport).

7.4. For hotel and car rental reservations, authorization receipts are usually issued in the form of a reservation number to be presented to the provider.
 

8. Insurance

8.1. We would like to point out that it is possible to take out travel cancellation insurance during the booking process to minimize the risk of cancellation costs for the customer.

8.2. Additionally, travel cancellation insurance does not typically cover losses incurred if the customer cancels the trip after it has started, even if through no fault of their own. Travel interruption insurance generally needs to be purchased separately.

8.3. We also recommend having adequate international health insurance coverage when traveling abroad.


9. Obligations Relating to Air Transportation Services

9.1. Pursuant to EU Regulation 2111/2005 on the establishment of a common list of air carriers, Seemezy is obliged to inform the customer of the identity of the operating airline at the time of booking. If the operating airline has not yet been determined at the time of booking, Seemezy will provide the information obtained from the intermediary about the airline likely to operate the flight. In case of a change in the airline, the customer will be informed immediately.
 

10. General Provisions

10.2. We generally make every effort to ensure that the information and other data available at the time of publication, particularly regarding prices and booking conditions, are up-to-date, accurate, and complete. However, since individual information about tourism services is based on information obtained from third parties, guarantees cannot be provided within the meaning of Section 276 Paragraph 1 Sentence 1 of the German Civil Code (BGB).

10.3. Seemezy emphasizes that all tourism services offered are provided only to a limited extent. Seemezy is not responsible for the availability of a specific travel service at the time of booking. No guarantee of availability is provided by Seemezy within the meaning of Section 276 Paragraph 1 Sentence 1 of the BGB.

10.4. Optional tours, excursions, car rentals, and similar services ("individual travel services") other than pre-booked and paid tourism services are carried out at the customer's own risk. Seemezy is not responsible for tours, excursions, car rentals, etc., booked locally through the provider or third parties.

10.5. Seemezy accepts no responsibility for the accuracy, completeness, or reliability of third-party content, particularly maps, automatic translations, customer reviews, editorial texts, and images of places and regions. The geographic data displayed on the website, especially maps, serve only as non-binding guidance regarding the approximate local location of the offer. However, only the location information provided to you during the online booking process and/or travel confirmation is binding for the conclusion of the contract.

10.6. The exceptions specified in Sections 10.1 through 10.4 apply unless Seemezy is aware of incorrect and/or false information or should have been aware of it through the exercise of ordinary commercial and industrial diligence. Seemezy’s liability for such cases is limited to intent and gross negligence.

10.7. Seemezy is liable only in cases of intent or gross negligence for non-physical damages, liability arising from assumed guarantees, and liability for breaches of fundamental contractual obligations (essential obligations). In the case of negligent breaches of fundamental obligations, liability is limited to contract-specific and foreseeable damages and, in any case, to three times the value of the provided tourism service.

10.8. Seemezy is not responsible for the loss or destruction of travel plans or travel documents in connection with a shipment for which it is not responsible.

10.9. Liability for force majeure is excluded. This includes, in particular, orders from authorities, wars, civil unrest, hijackings, terrorist attacks, fires, floods, power outages, accidents, storms, strikes, lockouts, or other industrial actions affecting Seemezy’s or suppliers’ services.

10.10. Seemezy’s responsibility for providing information and notices under Article 250 Sections 1 to 3 in conjunction with Section 651v Paragraph 1 of the BGB is limited to the proper selection of the information source and accurate transmission to the customer within the scope of statutory and contractual agreements. An information agreement involving a primary contractual obligation to provide information is concluded only through a corresponding explicit agreement. Without a special information agreement, there is no liability for the accuracy of the information provided per Section 675 Paragraph 2 of the BGB.

10.11. Seemezy’s liability for defective fulfillment of agency obligations or under Section 651x of the BGB remains unaffected by the above provisions.

10.12. While travel to international destinations, including those offered by Seemezy, is generally uneventful, some destinations may pose greater risks than others. Therefore, Seemezy advises customers to check all travel bans, warnings, announcements, and travel advice issued by the relevant foreign ministry before booking travel to international destinations. In Germany, such information is available from the Federal Foreign Office at www.auswaertiges-amt.de/de/ReiseUndsicherheit/10.2.8Reisewarningen.

10.13. By offering travel to specific international destinations, Seemezy does not represent or guarantee that travel to such destinations is advisable or risk-free and is not liable for any damages or losses resulting from travel to such destinations.
 

11. Final Provisions

11.1. Seemezy reserves the right to change these Terms and Conditions at any time with future effect without notifying the customer. The current version of these Terms and Conditions as of their effective date can be viewed on the Seemezy website. By making a booking, the customer declares acceptance of the applicable terms.

11.2. These terms contain the entire agreement between the customer and Seemezy for the brokerage contract and supersede all prior agreements, whether verbal, electronic, or written.

11.3. The contractual relationship between the customer and Seemezy is governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, regardless of the customer’s nationality.

11.4. For registered merchants, persons without a general place of jurisdiction in Germany, and persons who relocate their residence or habitual residence abroad after the conclusion of the contract or whose residence or habitual residence is unknown at the time of filing the lawsuit, the place of jurisdiction is Aachen.

11.5. If any provision of these terms is invalid or becomes invalid, this shall not affect the remaining provisions.

11.6. Regarding the law on the resolution of consumer disputes, Seemezy points out that it does not participate in voluntary consumer dispute resolution. If consumer dispute resolution becomes mandatory for Seemezy after the publication of these brokerage terms, Seemezy will inform consumers in an appropriate manner.

11.7. For all contracts concluded through electronic legal transactions, Seemezy refers to the European Online Dispute Resolution Platform at http://ec.europa.eu/consumers/odr.
